We provide professional electricity procurement, market analysis, and energy brokerage services to both residential and commercial clients within deregulated energy markets.
- Information We Collect
To provide accurate rate comparisons and facilitate energy contract enrollments, we collect specific information depending on your account type:
- For Residential Clients:
- Contact Details: Full individual name, billing address, service address, email address, and telephone number.
- Energy Consumption: Historical kilowatt-hour (kWh) electricity usage data.
- Renewal Records: Existing utility provider account numbers collected only if we are processing a contract renewal with your current provider.
- For Commercial Clients:
- Business Profile: Exact legal business name and Federal Tax ID / Employer Identification Number (EIN).
- Location & Identification: Service addresses and Electric Service Identifiers (ESIDs) or utility account numbers for all serviced properties.
- Energy Consumption: Historical kilowatt-hour (kWh) usage, peak demand metrics, and load profiles.
- Renewal Records: Existing utility provider account numbers collected only if we are processing a contract renewal with your current provider.
- How We Obtain Your Data
We collect data through transparent and lawful methods necessary to perform our brokerage duties:
- Direct Submission: Information entered into our website intake forms, submitted via email, or provided through physical onboarding documents.
- Authorized Retrieval: Historical usage and utility data retrieved directly from regional Transmission and Distribution Utilities (TDUs) or through authorized state meter data networks, acting strictly under the authority of a signed Letter of Authorization (LOA) executed by you.
- How We Use Your Information
Your data is used solely to execute energy procurement and brokerage functions on your behalf:
- Usage Analysis: Analyzing your historical energy consumption patterns (kilowatt-hour usage and peak demand) to identify optimal rate structures.
- Provider Procurement: Requesting custom pricing, residential rate options, customized commercial quotes, and retail electricity contracts from licensed Retail Electric Providers (REPs) or energy suppliers.
- Enrollment Processing: Facilitating your formal enrollment, provider switch, or contract renewal with your selected supplier.
- Account Management: Communicating with you strictly regarding your specific account status, contract confirmations, and upcoming contract renewal updates.
- Data Sharing and Disclosure
We maintain strict boundaries regarding who can access your personal and business information:
- With Licensed Energy Providers: We share your account details, service addresses, utility identifiers, and historical usage profiles exclusively with licensed Retail Electric Providers and suppliers for the sole purpose of securing electricity contracts.
- No Sale or Marketing Sharing: 1776 Energy LLC does not sell, rent, lease, trade, or share your personal or business data with third-party marketing companies, external brokers, or unrelated data aggregators.
- Legal & Regulatory Compliance: We reserve the right to disclose your data if required by a valid legal subpoena, court order, or in response to an official regulatory inquiry by an applicable state public utility commission or regulatory authority.
- Data Security and Storage
We maintain a comprehensive security program to protect your sensitive utility and identity data:
- Technical Safeguards: All data collected is stored securely using industry-standard AES 256-bit encryption protocols via secure enterprise cloud architecture.
- Access Controls: Access to client utility files, Tax IDs, and billing histories is strictly restricted to authorized personnel of 1776 Energy LLC who require the information to perform energy procurement tasks.
- Cloud Infrastructure Security: Our data environments are hosted within secure, enterprise-grade cloud providers that utilize advanced physical security, managed firewalls, and continuous vulnerability monitoring to mitigate data breaches, loss, or unauthorized intrusion.
- No Tracking Cookies or Automated SMS Marketing

- Your Rights and Data Control
You retain complete ownership over your data and how it is utilized by our firm:

- LOA Revocation: You hold the right to revoke a signed Letter of Authorization (LOA) at any time. Upon receiving written notice of revocation, 1776 Energy LLC will immediately cease pulling your historical or future energy data from utility networks.
- Data Retention and Deletion: You may request the deletion of your personal or business data from our systems at any time. Please note that we may retain certain records as required to fulfill active electricity contracts, manage multi-year renewals, or comply with mandatory state regulatory record-keeping rules.
PART 2: TERMS OF SERVICE
- Scope of Services & Relationship
1776 Energy LLC is a registered electric broker.
- Broker Status Only: We act strictly as an intermediary between you and licensed Retail Electric Providers (REPs) or energy suppliers. We are not an energy supplier, we do not generate or distribute electricity, and we do not issue your monthly utility bills.
- No Utility Responsibilities: Any issues regarding power outages, line maintenance, or billing discrepancies must be managed directly with your local Transmission and Distribution Utility (TDU) or your chosen retail supplier.
- Service Fees and Broker Compensation
- No Direct Client Fees: 1776 Energy LLC does not charge residential or commercial clients any direct fees for our standard utility rate comparison and procurement services.
- Broker Compensation Disclosure: In compliance with applicable regulatory standards, you acknowledge that 1776 Energy LLC is a compensated intermediary. Our brokerage services are funded via commissions paid directly by the retail energy provider or supplier with whom you choose to enroll.
- Rate Quotes and Market Volatility
- Quotes are Non-Binding: Any electricity rate quotes provided by 1776 Energy LLC are estimates based on wholesale market conditions at that specific moment. Rates fluctuate constantly and are not guaranteed until a final contract is formally accepted, processed, and executed by the chosen supplier.
- No Future Performance Guarantees: We provide rate comparisons based on historical data and current market availability. We offer no guarantees that the selected rate will remain the lowest option available in the market during the life of your contract.
- Utility Pass-Through Charges: You acknowledge that retail electricity rates are subject to change based on adjustments to non-bypassable delivery fees mandated by local utilities and approved by governing regulatory bodies. 1776 Energy LLC is not responsible for changes to your total bill resulting from utility rate adjustments.
- Finality of Contracts
Once you sign an electricity supply contract with a provider, that contract constitutes a legally binding agreement strictly between you and that provider. 1776 Energy LLC has no authority to alter, cancel, or terminate your contract, nor are we liable for any early termination fees you may incur if you switch providers.
- Limitation of Liability
To the maximum extent permitted by law, 1776 Energy LLC, its officers, and its employees, shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of our Services. This includes, but is not limited to, loss of business revenue, power interruptions, grid failures, billing errors by the provider, or data breaches occurring outside our direct control.
Because our brokerage and procurement services are provided to you at no direct cost, you agree that 1776 Energy LLC holds zero financial liability ($0.00) for any claims, losses, or disputes arising under these Terms.
- Dispute Resolution & Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
- Mandatory Arbitration: You and 1776 Energy LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy Policy, or our Services will be settled through binding, individual arbitration, rather than in a court of law.
- Waiver of Jury Trial: You agree to waive your right to a trial by jury or to participate in a class-action lawsuit against 1776 Energy LLC.
- Location: Any arbitration proceedings will take place in the State of Texas and will be administered by a recognized arbitration association (such as the American Arbitration Association) under its commercial rules.
- Governing Law
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
